A legal setback for the proposed Lago Resort and Casino in Seneca County.

A New York State Appeals Court has voided the proposed plan to build the casino and resort in Tyre. The court said the Tyre Town Board did not provide a clear explanation that the proposal would not cause significant environmental damage.

In a statement Desiree Dawley of "Casino Free Tyre" says Friday's decision is a significant victory for their community. She says “the decision provides further confirmation that at every turn, the Tyre Town Board failed to meet its most basic obligations before signing off on the largest development project in our county’s history. In December the State Gaming Commission recommended that Lago Resort and Casino receive the casino license for the Finger Lakes and Southern Tier region.
