Indictment: Binghamton Couple Charged With 18 Counts Of Sex Abuse

BINGHAMTON, N.Y. -
A Broome County Grand Jury Friday handed up an 18-count indictment of Derrick D. Cervini and Heather M. Kasmarcik, for Predatory Sexual Assault Against a Child, Class A-II Felonies, along with several other counts related to attacks on children.
According to the indictment, Cervini and Kasmarcik, acting in concert with one another, sexually assaulted,
raped and abused three children between June 2014 and June 2016.

130.96 Predatory Sexual Assault Against a Child, a Class A-II Felony;
130.50 Criminal Sexual Act, in the first degree, a Class B Felony (five counts);
130.35 Rape, in the first degree, a Class B Felony (two counts);
263.05 Use of a Child in a Sexual Performance, a Class C Felony (two counts);
130.80 Course of Sexual Conduct Against a Child, in the second degree, a Class D Felony;
130.65 Sexual Abuse, in the first degree, a Class D Felony;
120.05 Assault, in the second degree, a Class D Felony; and
260.10 Endangering the Welfare of a Child, a Class A Misdemeanor (five counts).

130.96 Predatory Sexual Assault Against a Child, a Class A-II Felony;
130.50 Criminal Sexual Act, in the first degree, a Class B Felony (four counts);
130.35 Rape, in the first degree, a Class B Felony (two counts); and
260.10 Endangering the Welfare of a Child, a Class A Misdemeanor (two counts).
The defendants were arrested in October 2018, by the New York State Police, for Criminal Sexual Act. The
Broome County District Attorney's Office Special Victims Bureau indicted on additional charges.
All defendants are presumed innocent until proven guilty in court.
