Akshar Supporters Sue Fiala

The race for the 52nd District State Senate seat may be headed to court before it goes to the ballot box.

A number of plaintiffs including the head of the Broome County Republican Party are asking a State Supreme Court Judge to remove Democratic Nominee Barbara Fiala from the Women's Equality Party Line. This after another Supreme Court judge last week prohibited anyone from certifying candidates on that line because a majority of the party's 2014 nominees did not sign off on three sets of rules submitted to the Board of Elections.

Fiala's campaign has blasted the lawsuit, saying those behind it are former or current staffers of convicted State Senator Tom Libous. Broome County Democratic Chairman Jim Testani says Republican candidate Fred Akshar's claim to be an outsider is hypocritical since his campaign is being run and paid for by corrupt albany politicians.

The head of the Broome County GOP Bijoy Datta, who is a party to the suit, says Fiala and Governor Cuomo tried to game the system by engaging in a fraudulent scheme to allow her to run on the Women’s Equality Line in direct violation of the court’s order.

An Order to Show Cause hearing will take place in Albany Tuesday morning at 9:30.
