US Attorney: Libous Conviction Should Stand

The US Attorney who prosecuted former State Senator Tom Libous says his conviction should stand - this as Libous has appealed to have his conviction tossed and a new trial.

Libous' defense is arguing that the evidence was insufficient to support the jury's
verdict. A jury found Libous guilty of providing a false statement to the FBI. US Attorney Preet Bharara says those arguments are mostly a rehash of the arguments he made unsuccessfully to the jury.

Given the volume and strength of the evidence proving the defendant's guilt, a rational jury could and did find the defendant guilty beyond a reasonable doubt on all counts and there can be no concern here that the defendant is innocent. Bharara says the evidence at trial was more than sufficient to support the jury's verdict.
