Fracking Battle Headed to Court

With the state asking a judge to toss a pair of lawsuit's challenging New York's delay in allowing fracking, an attorney leading one of those suits says the state is off base.
   
The suits are from attorneys representing a bankruptcy trust of Norse Energy and those from the Joint Landowners Coalition of New York. The suits claim the state's delay goes against its own environmental review laws.

An attorney for the Joint Landowners says one of the state's arguments to dismiss is that gas drilling in New York is speculative, a point of view he says the facts don't support.

"That could not be further from the truth. If you've seen maps of what's going on in Pennsylvania to New York, the wells and our geology do not just magically stop at the New York/Pennsylvania border," said Scott Kurkoski.

"The legal piece of this is best left to the Attorney General. I can speak to what's best for New York and that's that these lawsuits are a frivolous waste of money," said Isaac Silberman-Gorn of Citizen Action.

A judge is expected to rule on the state's request to dismiss the suits on April 25th.
