Fracking Suit Delay
3/5/2014 (Updated 9:51:25 PM)One of the lawsuits against New York State meant to challenge its delay on deciding whether to allow fracking has been adjourned.
Norse Energy's suit against the state was scheduled to be heard before a judge in Albany on Friday.
Instead, it may be heard in April alongside a suit brought by the Joint Landowners Coalition of New York.
Both suits claim the state has violated its own environmental review laws in delaying a decision.
The suits could force discovery of communications between the Governor's office and the departments of health and environmental conservation regarding fracking.
"We expect the case to move forward. There may be other discovery orders that come from the judge providing a certain discovery from the state. That's where these documents will come into play. We'll start to find out what the state has, or in this case, has not done," said Scott Kurkoski, attorney for the Joint Landowners Coalition of New York.
The state has until April 4th to respond to the Joint Landowners suit.
