Fracking Lawsuit Delayed

The attorney suing New York State over its failure to make a decision on hydrofracking says the latest request to delay the hearing is another example of stall tactics.

Attorney Tom West represents the now defunct Norse Energy.

Last week, an Albany judge granted the state an extra six weeks to prepare for its hearing against Attorney West. This pushes the hearing from January 24th to March 7th.

We spoke with Mr. West Thursday about the decision and what this means for his case.

"We see it as an effort to delay their day in court, our day in court...Our opportunity to force them to come in and tell everybody in New York State what they have been doing for the past five and half years and final standards now," said West.

West is asking the court permission to depose DEC Commissioner Joseph Martens and Health Commissioner Shah before the March 7th hearing.

West is representing Norse Energy in the lawsuit against the towns of Dryden and Middlefield, which will be decided by the state's highest court.
