Joint Landowner's Coalition Taking Donations for Pursuit of Lawsuit Against NYS
3/25/2013 (Updated 11:03:22 PM)A landowner group fighting against the state's ban on fracking is now asking for money to fund a lawsuit against the state.
The Joint Landowners Coalition of New York has set up a landowner defense fund.
The group plans on suing the state over its fracking moratorium, claiming the ban is a taking of the landowners' mineral rights.
The group is looking for donations, and expert witnesses to testify to the value of those minerals to establish a value of the taking.
"We're not announcing our actual goals but just to give you some idea the expert witnesses alone will probably be more than $100,000. So we'll need a large war chest in order to wage this battle which I think will begin against our state," said Joint Landowners Coalition of New York attorney Scott Kurkoski.
The group anticipates having two or three plaintiffs who own only the subsurface rights to their land to make the argument that the state is taking all use of that land from them.
