The State's Teachers' Union is suing New York over the property tax cap.
NYSUT is suing over the state's two-percent tax cap which the legislature passed in 2011.
NYSUT claims it gives some voters more influence than others since it requires 60% of voters in a school district to allow that district to exceed the tax cap.
"If it came in with 59% to exceed the tax cap, 41% to not, that 41% has more weight. You're kind of losing the, 'one man, one vote," said Catherine Klein, Regional Director for NYSUT.
Dean Skelos, State Senate Republican Leader, says the suit had no merit and that the cap sent a message to lawmakers on behalf of those who were drowning in property taxes and finding it difficult to pay their bills.
