Defense of Marriage Act Struck Down

A New York appeals court today struck down the Defense of
Marriage act in a two-to-one ruling today claiming it violates the constitution's equal protection clause.

Under the law, the Federal Government does not recognize same-sex marriage and it allows states the option to refuse to recognize it as well. The New York appeals court is now the nation's second to deem the Defense of Marriage act unconstitutional.

An appeals court in Boston concluded the same earlier this year. The issue is expected to go to the Supreme Court.
