Attorney: School Gun Threats False

The Union-Endicott school district could be facing legal action following its year long suspension of two boys at the Jennie F. Snapp Middle School.

Attorney Ron Benjamin says the suspension process was unfair
and came without due process or presentation of evidence.

The mother of one of the boys spoke to us this week explaining that her son, an eight-grader, was accused by two other students of threatening to bring guns to the school and shoot students.

Dana Echauri says the accusations are false, and followed a bullying incident involving her son's two  accusers.

"Apparently, five to ten minutes before hand, my son was attacked on the playground with a game called 'smear the queer' and there were two other witnesses to the incident, and when my son told them, they brushed it off as having nothing to do with the matter at hand, but so far, I've seen no action to investigate the incident that happened," said Echauri.

" We don't know what they're saying was said...we don't know what the factual finding was to take two boys who were not trouble-makers and take them out of school for a year, that is about as gross a denial of due process as you're going to get," said Atty. Benjamin.

Benjamin has requested to be at a hearing before the school board, to have the suspension reversed.

The year-long suspension formally began June 11th. The school district says privacy laws prevent discussion of the matter.
