DA And Defense Attorney React to Kenyon Verdict - 7/31/2010

After eight hours of deliberation, the jury in the William Kenyon trail reached a verdict:  guilty of manslaughter in the first degree and criminal trespass in the second degree.  Kenyon was also charged with second degree murder in last year's asphyxiation killing of his girlfriend, Kelly Wescott.
   
After asking the court to clarify and read back certain excerpts of testimony, jurors arrived at their conclusion: guilty of manslaughter and criminal trespass, but not of murder.

Defense attorney Michael Mullen says it may have been difficult for the jury to say Kenyon was innocent because of the statements that he made admitting he killed Wescott.

"If you look at the real evidence in the case, that there was some problem with the sign of struggle in the apartment.  I don't think there was signs of struggle in the apartment.  I don't think there was much trauma to her body or his body.  I don't know if a murder had taken place," said Mullen.

Both attorneys stand by the jury's decision, however, saying it was a  difficult case and they handled all the information well.

"Whatever they jury returns in the just verdict and we've informed the family and they seem satisfied with the outcome," said Gerald Mollen, Broome County District Attorney.

Wescott's family said they chose to hear the verdict over the phone to avoid the tough and awkward situation in the court room.

Kenyon's sentencing is scheduled for September 30. He could face up to 25 years in prison.
