Fiala Will Take B.C. Legislature to Court - 11/23/2009

County Executive Barbara Fiala vetoed five spending items last week.

Legislators overrode three of those vetoes, and let two others stand. 

Here's the breakdown:

Fiala's veto of revenue increases for passport fees and matters associated with oil and gas leases stands.

Her veto of restoring a Deputy Clerk Position was overridden.

Her veto of increasing Cooperative Extension funds was overridden.

Her veto of restoring a Youth Services Specialist stands.

Her veto of increasing Soil Conservation service was
overridden.

Overall, legislators say they're fine with the result:

"I was an advocate of Cooperative and Soil Water, on those two the vetoes were overridden.
I was an advocate of the Youth Bureau, that was not overridden...OK, that's good government," said B.C.
Legislator Stephen Herz.

Some of the legislative overrides involve increases in spending.
Fiala says legislators have the power to decrease spending--not increase it.  So, she is taking the issue to court:

"We will stand behind looking at legal action regarding the overrides that took place," said Budget Director Marie Kalka
 
"I don't understand the amount of money it will cost to take us to court.
Is that going to be more than we're actually putting back into the budget? I'm not sure if that's a wise move," said B.C.
Legislator Richard Materese.

"I don't think the taxpayers want to see two branches of government not cooperating to the extent that we've got a Supreme Court judge involved--it just absolutely makes no sense to me, " said B.C.
Legislative Chair Dan Reynolds.
 
"What we want to do is settle this once and for all: Who has legal authority to increase the budget.
We will meet with our legal counsel and see what direction we need to go from here," said Kalka.
