Sidney Will Not Appeal Judges Decision on Fracking
2/21/2014 (Updated 10:47:48 PM)The Town of Sidney will not appeal a judge's decision that struck down the fracking ban imposed by the Sidney town board last year.
The judge ruled the ban invalid because it was not passed by a super majority of the Sidney board.
The attorney for those suing the board argued that a super majority is needed if landowners who own at least 20 percent of acreage in a municipality sign a petition protesting a change in zoning.
The town board says the ban was a moratorium, not a zoning amendment.
