Joint Landowners Coalition Files Lawsuit Against New York State

In our area the Joint Landowners Coalition of New York filed a lawsuit against the State of New York Friday.

The suit claims Governor Cuomo is acting without jurisdiction by orchestrating the delay in deciding whether fracking should go forward in New York, and interfering with the decision making authority of the State's Department of Environmental Conservation.

There will be a hearing on the suit in Albany County on March 7th.

"What is obvious to everyone involved in this process is that we're not looking at the science or the facts any longer. We are looking at the Governor who is putting this strategy together to avoid the issue until after the election," said Scott Kurkoski, attorney for the Joint Landowners Coalition of New York.

"This is a frivolous lawsuit. It's a desperate PR attempt by really the mouth piece for the gas industry. In the face of a growing majority of New Yorkers who don't want fracking and a growing body of science saying that it can't be done safely," said Isaac Silberman-Gorn the Community Organizer at Citizen Action.

Kurkoski says he will ask a judge to compel the governor's office, state Health Department, and DEC to release its emails and communications regarding its decision-making process on fracking.
