"Kick a Jew" Case Appeal

At Vestal High School, there's still a unresolved problem regarding punishment of a student who was part of "Kick-a-Jew" Day.

In December of 2010, several students reportedly kicked Jewish students, in what was claimed to be just a take-off on a parody of prejudice, as seen in an episode of South Park.

In the episode, the victims of discrimination are "gingers," that is, people with red hair.

A student who was suspended following the incident appealed the case, and a judge found that the suspension should be expunged from the record, because of proceedural errors.

Now, the school is making it's own appeal, to the New York State Supreme Court.  It wants the decision to suspend upheld, and the record of it, to stand.
